Circle’s USDC Becomes EU’s First Significant E-Money Token Under MiCA

Circle’s USDC has become the first e-money token to receive “significant” status under the European Union’s Markets in Crypto-Assets Regulation (MiCA), bringing the dollar-backed stablecoin under direct European Banking Authority (EBA) supervision for key financial safeguards from November 12, 2026.

The EBA announced the decision on October 14 following an assessment of USDC against MiCA’s significance criteria. Of the 45 e-money tokens notified under the framework, USDC is the first to receive the designation.

The classification introduces an additional layer of regulatory oversight rather than changing USDC’s dollar peg or its existing authorization to operate in Europe. It also establishes a division of responsibilities between the EBA and France’s Autorité de Contrôle Prudentiel et de Résolution (ACPR), which currently supervises Circle’s European operations.

EBA to Oversee USDC’s Reserves and Liquidity

Under the new arrangement, the EBA will assume direct responsibility for supervising USDC’s own-funds requirements, reserve assets, liquidity standards, and recovery and redemption plans beginning November 12.

These safeguards are intended to ensure that the issuer maintains adequate financial resources, holds sufficient assets to support the stablecoin, and can meet redemption requests. Recovery plans also establish procedures for responding to financial difficulties.

The ACPR will retain responsibility for other aspects of Circle’s European business, including corporate governance, qualifying ownership interests, assessments of senior management, outsourcing arrangements, and conflicts of interest.

The two regulators will coordinate their work to maintain continuity in supervision. This division of responsibilities follows Article 117 of MiCA, which establishes a framework for supervising significant e-money tokens.

USDC is issued in the European Union by Circle Internet Financial Europe SAS, while Circle Internet Financial, LLC handles issuance in the United States. Circle obtained authorization from France’s ACPR in July 2024 to issue USDC and its euro-backed stablecoin EURC under the European regulatory framework.

The latest designation therefore does not mark USDC’s initial entry into the EU market. Instead, it subjects the token to additional oversight because of its significance under MiCA.

Why USDC Qualified for Significant Status

MiCA sets specific criteria for identifying e-money tokens that warrant enhanced supervision. Under Article 56, the EBA must classify an e-money token as significant when it meets at least three of the criteria established under Article 43.

These criteria cover factors such as the number of tokenholders, the value of tokens issued, transaction activity, and the extent of their use. The EBA’s October 14 announcement did not specify which individual criteria USDC met.

USDC is the world’s second-largest stablecoin by market capitalization, behind Tether’s USDT. Its dollar peg makes it widely used for crypto trading, transfers, and other digital asset transactions.

Its scale and cross-border operations also make reserve management and coordination between regulators important considerations. Under MiCA, the EBA periodically reassesses whether tokens continue to meet the requirements for significant status.

EBA and New York Regulator Strengthen Cooperation

Alongside the classification, the EBA confirmed a memorandum of understanding with the New York State Department of Financial Services (NYDFS) to facilitate information sharing and cooperation on cross-border stablecoin activities.

The agreement reflects the challenges of supervising stablecoins issued through entities operating in different jurisdictions. Although Circle’s European and US entities are separate legal issuers, their operations are connected through the broader USDC ecosystem.

Cooperation between regulators can help authorities monitor relevant risks and coordinate their supervisory work. However, the memorandum does not replace either regulator’s existing legal responsibilities.

The move comes as international authorities pay closer attention to stablecoins that operate across borders. For issuers such as Circle, maintaining compliance across different regulatory systems is becoming an increasingly important part of their business.

Circle Continues to Challenge Parts of MiCA

The new classification arrives amid an ongoing debate over the EU’s stablecoin rules. In October, Circle called on European policymakers to reconsider requirements governing the reserve assets that issuers must hold.

Under MiCA, issuers must maintain reserves in accordance with specific requirements, including minimum bank-deposit thresholds. Circle has argued that mandatory deposits with commercial banks can expose stablecoin issuers to risks associated with their banking partners.

The company has pointed to the 2023 collapse of Silicon Valley Bank, when approximately $3.3 billion of USDC reserves became temporarily inaccessible, as an example of the risks involved.

Debate over reserve requirements highlights the challenge regulators face in balancing financial stability with the practical needs of stablecoin issuers. While reserves must remain sufficiently liquid to support redemptions, their composition can also affect issuers and the wider banking system.

The EBA’s decision does not introduce changes to these rules. USDC’s significant status applies the existing MiCA framework and transfers specific supervisory responsibilities to the European authority.

What the Decision Means for Europe’s Stablecoin Market

USDC’s designation marks a new stage in the EU’s oversight of large stablecoins. From November 12, the EBA will directly supervise key financial safeguards for the token, while the ACPR continues overseeing other aspects of Circle’s European operations.

For Circle, the change means additional regulatory scrutiny of its reserves, liquidity, and financial resilience. For the wider market, it provides a concrete example of how MiCA’s enhanced supervisory framework applies to a major stablecoin.

The decision also underscores the importance of coordination between regulators as digital assets increasingly operate across national borders. With the EBA and NYDFS establishing a formal channel for cooperation, authorities are building mechanisms to address the challenges posed by stablecoins with international reach.

USDC’s classification does not resolve the broader debate over how stablecoins should be regulated in Europe. However, it establishes a clearer supervisory structure for one of the market’s largest dollar-backed tokens as the EU continues implementing its crypto regulatory framework.
